1About these terms

These terms apply to your use of nakhlastudio.com (the “website”), which is run by Nakhla Studio, a business operated by Obie Elghreaw and based in the United Kingdom (“we”, “us”, “our”). By using the website you agree to these terms. If you do not agree, please do not use it.

These terms cover the website only. If we agree to build something for you, that work is covered by a separate written proposal or agreement, which takes priority over these terms for that work.

Please also read our Privacy Policy, which explains how we handle personal information.

2Using the website

You may use the website for lawful purposes only. You must not:

• try to gain unauthorised access to the website, its hosting or any connected system, or interfere with how it works;
• introduce malicious code, or send automated requests in a way that harms the site or its performance;
• use the contact form or our contact details to send unlawful, abusive, misleading or unsolicited promotional material, or to impersonate anyone; or
• copy, scrape or reuse the website’s content in a way that breaks these terms.

3Information on the website

The website describes our services and projects in general terms. It is provided for information only and is not professional, legal, financial or technical advice, and it is not an offer capable of acceptance. A contract for our services is formed only when we both agree a written proposal or agreement.

Some projects shown are described as “in development”. Those descriptions, and the simplified illustrations of each interface, are indicative and may change. We try to keep the website accurate and up to date, but we do not guarantee that it is complete or error-free.

4The contact form and enquiries

The contact form does not send anything to our website: it opens your own email app with your message pre-filled, and you decide whether to send it (see the Privacy Policy for details). Sending an enquiry does not create a contract, and we cannot promise a reply within a particular time or that we will be able to take on your project.

You are responsible for the content of what you send. Please do not include sensitive information such as passwords, payment card numbers or government ID numbers.

5Intellectual property

The website’s design, text, logo, illustrations and code are owned by or licensed to Nakhla Studio and are protected by intellectual property laws. You may view the website, and share links to it, but you may not copy, adapt or reuse its content for commercial purposes without our written permission. Ownership of anything we build for a client is set out in our agreement with that client.

The website uses open-source fonts, which remain subject to their own licences. Names and logos of other companies belong to their owners.

6Links and third-party services

The website may link to third-party websites and services. We do not control them and are not responsible for their content, availability or privacy practices. Using them is subject to their own terms.

7Availability

The website is provided “as is” and “as available”. We may change, suspend or withdraw any part of it at any time, and we do not guarantee that it will always be available or free from errors or interruptions.

8Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, your statutory rights are not affected.

Subject to that, and because the website is free to use, we are not liable for any loss arising from your use of, or inability to use, the website or from relying on its content, including loss of profit, revenue, business, data or goodwill, or any indirect or consequential loss. Liability for our services is governed by the agreement we make for them.

9Changes to the website and these terms

We may update these terms from time to time. The “last updated” date is at the top of this page, and the current version applies each time you use the website.

10Governing law

These terms, and any dispute arising from them or from your use of the website, are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction. If you are a consumer living elsewhere, you also keep any mandatory protections of the law of the country where you live.

3المعلومات الواردة في الموقع

5الملكية الفكرية

تصميم الموقع ونصوصه وشعاره ورسومه التوضيحية وشيفرته البرمجية مملوكة لـ«نخلة ستوديو» أو مرخّصة لها، ومحمية بقوانين الملكية الفكرية. ويجوز لك تصفّح الموقع ومشاركة روابطه، لكن لا يجوز لك نسخ محتواه أو تعديله أو إعادة استخدامه لأغراض تجارية دون إذن كتابي منا. أما ملكية ما نبنيه لأي عميل فتحدّدها اتفاقيتنا مع ذلك العميل.

يستخدم الموقع خطوطًا مفتوحة المصدر تبقى خاضعة لتراخيصها الخاصة. وأسماء الشركات الأخرى وشعاراتها تعود لأصحابها.

6الروابط وخدمات الأطراف الثالثة

قد يتضمن الموقع روابط إلى مواقع وخدمات أطراف ثالثة. ولا نتحكّم بها ولسنا مسؤولين عن محتواها أو توافرها أو ممارسات الخصوصية فيها، واستخدامها خاضع لشروطها الخاصة.
